Webmasters can no longer just work only on technical matters of their websites but must also become readers and editors of the content posted onto their websites. In short webmasters are now "editors" in charge of the content and are responsible for damages and liabilities incur because of the content whether it is posted by them or not. The same as for "print" media.

...ศาลพิเคราะห์แล้วเห็นว่า ข้อความทั้ง 10 กระทู้ ดูหมิ่นพระมหากษัตริย์ พระราชินี รัชทายาทอันเป็นความผิดเกี่ยวกับความมั่นคงแห่งราชอาณาจักร และนำเข้าสู่เว็บบอร์ดของเว็บไซต์ประชาไท แต่โจทก์ไม่มีพยานหลักฐานว่าจำเลยจะเป็นผู้นำข้อความกระทู้ทั้ง 10 เข้าสู่ระบบคอมพิวเตอร์ หรือจงใจ สนับสนุนให้กระทำความผิดดังกล่าวในระบบคอมพิวเตอร์ที่อยู่ในความควบคุมของจำเลย จึงฟังไม่ได้ว่าจำเลยกระทำความผิด ฐานนำเข้าสู่ระบบคอมพิวเตอร์ซึ่งข้อมูลคอมพิวเตอร์ใดๆ อันเป็นความผิดเกี่ยวกับเป็นความมั่นคงแห่งราชอาณาจักร ตาม พ.ร.บ.ว่าด้วยความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ.2550 มาตรา 14(3) และฟังไม่ได้ว่าจำเลยจงใจหรือสนับสนุนให้มีการกระทำความผิดดังกล่าว

ศาลเห็นว่าเป็นหน้าที่ของจำเลยในฐานะผู้ให้บริการแต่ยังไม่เพียงพอภาระหน้าที่ของจำเลยในการควบคุมดูแล ที่ให้มีการกระทำความผิดในระบบคอมพิวเตอร์ที่อยู่ในการควบคุมของจำเลยมีอยู่เช่นใดก็คงมีอยู่เช่นนั้นไม่เปลี่ยนแปลง ส่วนจุดประสงค์ของเว็บไซต์ที่ต้องการนำเสนอข้อมูลข่าวสารที่ถูกต้อง มุ่งเน้นในเรื่องสิทธิที่ถูกต้องในส่งเสริมประชาธิปไตยนั้น ศาลยอมรับว่าสิทธิเสรีภาพในการแสดงความคิดเห็น เป็นสิทธิขั้นพื้นฐานของพลเมืองซึ่งรับรองและคุ้มครองไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทยทุกฉบับ เพราะเสรีภาพการแสดงความคิดเห็นสะท้อนถึงธรรมาภิบาลและความเป็นประชาธิปไตยของประเทศ หรือองค์กรนั้นๆ การวิพากษ์วิจารณ์จากประชาชนทั้งด้านบวกและด้านลบย่อมเป็นโอกาสในการนำไปปรับปรุงประเทศ องค์กรและตัวเองให้ดียิ่งขึ้น

แต่เมื่อจำเลยเปิดช่องทางให้แสดงความคิดเห็นในระบบคอมพิวเตอร์ ซึ่งอยู่ในความดูแลของจำเลย จำเลยย่อมมีหน้าที่ในการตรวจสอบข้อคิดเห็น หรือข้อมูลที่อาจกระทบกระเทือน ถึงความมั่นคงของประเทศ รวมทั้งสิทธิเสรีภาพของผู้อื่นที่ต้องเคารพเช่นกัน เมื่อจำเลยกระทำผิดตามที่วินิจฉัยมาข้างต้นจำเลยจึงมิอาจอ้างซึ่งสิทธิเสรีภาพในการแสดงความคิดเห็นดังกล่าวเพื่อให้หลุดพ้นจากความผิดได้ พิพากษาว่า จำเลยมีความผิด พ.ร.บ.ว่าด้วยความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ.2550 ลงโทษจำคุกดังกล่าว ส่วนข้อหาอื่นให้ยก...

I do think that "duty and responsibility" must be taken seriously and "equally by everyone". We have government departments and many public servants "failing" in their duties and responsibilties, yet rewarded for not doing their jobs.

Here is a case that serves as a reminder to all webmasters that they are responsible for "cleaning up" any rubbish that any people throw in their "home". You and I can be prosecuted for not picking up and destroying a piece of paper "a red shirt" left in our front yard. The government is now bound by duty and responsibility for any "defamation messages" and grafitis left by anyone anywhere in the country. Let us see the duty and responsibility taken "seriously"

Bangkok Criminal Court Judge Kampol Rungrat said his guilty verdict was based on one particular post that was left on the Prachatai site for 20 days.

Chiranuch "did not perform her duty in a timely manner" and "allowed the inappropriate posting to be on the website for too long," the judge said.

Chiranuch was initially given a one-year suspended sentence that was immediately reduced to eight months, on the basis of her cooperation with the court and being a good citizen.

We now see that webmasters' responsibilities extended to cover "content of" content not just technical matters in delivering and maintaining web content text and pictures (and other multimedia files).

If we have 50 hours of content added to a web site everyday, how could a webmaster inspect "all new" content in 8 (24?) working hours. This may be happening on G2K... poor Dr Chan...
