SEC will consider Yingluck's case.
The Securities and Exchange Commission has reversed its earlier stance of indifference and decided to look into the allegation of false reporting of share transactions by Yingluck Shinawatra.
“The SEC is not being pressured into this,” secretary-general Thirachai Phuvanatnaranubala hastened to say on Monday. Earlier the SEC said it was not considering the allegations against Pheu Thai's top party-list candidate.
Among the reasons was that Ms Yingluck was not required to report to the SEC because she owned less than 5% of the total shares in the companies concerned.
The youngest sister of fugitive former prime minister Thaksin, Ms Yingluck has been accused of filing false reports of her shareholdings in Shin Corp and Ample Rich Investments which she allegedly held as a proxy for Thaksin and his then wife Khunying Potjaman na Pombejra.
Thaksin was convicted of wrongfully accruing wealth through misuse of his authority when prime minister when the Supreme Court last year.
The court confiscated 46 billion baht of his frozen assets, but did not touch the rest of the 70-plus billion baht. The decided MS Yingluck was a proxy, holding shares for her brother Thaksin - who as prime minister was not allowed to control the shares.
Aware that the investigation is being carried out during the lead-up to the election, Mr Thirachai said the SEC will “limit its consideration” by looking into Ms Yingluck’s role under the Securities and Exchange Act, without seeing it from a point of view under criminal law.

ท่ามกลางสาเหตุที่ถูกกล่าวว่ายิ่งลักษณ์ ไม่ได้รายงานไปที่ ก.ล.ต. เนื่องจากเธอเป็นเจ้าของต่ำกว่า 5 % ของจำนวนหุ้นในบริษัทที่เกี่ยวข้อง
ยิ่งลักษณ์น้องสาวอดีตนายกรัฐมนตรีทักษิณที่ได้หลบหนี ได้ถูกเป็นผู้ต้องหาของการยื่นรายงายเท็จผู้ถือหุ้นชินคอร์ปอเรชั่นและการลงทุนที่ร่ำรวย ซึ่งเธอมีความใกล้ชิดกับทักษัณและคุณหญิงพจมาน
ทักษิณเป็นผู้ที่ถูกตัดสินว่ามีความผิดจากการใช้อำนาจเมื่อได้รับการแต่งตั้งเป็นนายกรัฐมนตรี โดยศาลฎีกาในปีสุดท้ายศาลได้ยึดสินทรัพย์ประมาณ 46 พันล้านบาท แต่ไม่ถึง 70 พันล้านบาท
ยิ่งลักษณ์มีความใกล้ชิดถือหุ้นให้กับพี่ชายทักษิณ ใครที่เป็นนายกรัฐมนตรีไม่ควรอนุญาตให้ควบคุมการใช้ร่วมกัน
การตระหนักถึงการสอบสวนได้มีการดำเนินไปในระหว่างรอเพื่อเลือกตั้ง นายธีระชัย เห็นว่า ก.ล.ต. ควรจะ “จำกัดการพิจารณา” โดยตรวจสอบยิ่งลักษณ์ภายใต้บทบาทการกำกับหลักทรัพย์และกฎหมายการแลกเปลี่ยน โดยไม่เห็นจากมุมความผิดภายใต้กฎหมายอาญา
