คำถามวัยรุ่น Are you sexually active ? Are you aware of Florida law?

เวลานั่งในห้องตรวจ สังเกตุ ดูคุณ หมอ หรือ พยาบาลเวชปฏิบัติที่นี่ เมื่อตรวจ คนไข้เข้าวัยรุ่น

ในกระดาษ แบบฟอร์มบันทึกของผู้ป่วยอายุมากกว่า  9 ขวบ จะมีช่องให้กรอกข้อมูล ซึ่งทำให้

คุณหมอต้องตั้งคำถาม ถามผู้ป่วย(หรือไม่ก็ผู้ดูแล)ทุกครั้งไปว่าว่า

 Are you sexually active ?

ถ้าตอบ yes หรือเด็กมีลักษณะที่เป็นหนุ่มเป็นสาวปรากฏแล้ว  ก็จะถามคำถามต่อว่า 

 Are you aware of Florida law? ทุกครั้งไป

จับใจความว่ากฏหมาย ของรัฐฟลอริดา  ซึ่งไมอามี่ก็ เป็นเมืองหนึ่งในรัฐนี้    หากคนที่มีเชื้อ เอชไอวี ไปมีเพศสัมพันธ์ กับใครโดยไม่บอกให้ทราบว่าเขามีเชื้อเอชไอวีนี้อยู่ ถือเป็นสิ่งผิดกฏหมายของที่นี่ ฟ้องร้องกันได้ เข้าคุกได้ นะ

อาจารย์ อมา เวกา เล่าเกร็ดให้ฟังว่าปกติ เราก็ไม่ทราบว่าใครไปมีเพศสัมพันธ์ กับใครหรอก บังเอิญ มีกรณี ตัวอย่างว่า

เด็กชาย ที่มีเชื้อ เอชไอวี ซึ่งมาตรวจเป็นคนไข้ประจำที่คลินิก  พอเป็นหนุ่มก็มีแฟน และทำให้ หญิงท้อง   จนคลอด และสามารถพิสูจน์ ได้จากการตรวจ ยีนส์ทารกได้ว่า เป็นลูกเด็กชายคนนี้จริง 

กรณีตัวอย่างนี้ทำให้ ได้ใช้กฏหมายฉบับนี้จริงๆ และแม่เด็ก ก็ฟ้อง ได้ค่าเสียหาย  และก็ คนไข้ของเราก็ เข้าคุกจริงๆไปแล้วนะคะ

ตัวเนื้อกฏหมายกำหนดไว้ค่ะ เป็นความผิดทั้งสิ้น ไม่ว่าจะเป็นโรคเอดส์ หรือ โรคติดต่อทางเพศสัมพันธ์ ทั้งหลาย 

 กฏหมายนี้มีขึ้นก็ เนื่องจาก ฟลอริด้า เป็นหนึ่งในสามรัฐ ที่มี การระบาดของโรคเอดส์ สูงสุด อีก สองรัฐ ได้แก่ นิวยอร์ก และ California

เลยหา ตัวกฏหมายจริงมาฝากกันค่ะ ซึ่งเป็น Title XXIX Chaptor 384 ดังนี้

(1)  It is unlawful for any person who has chancroid, gonorrhea, granuloma inguinale, lymphogranuloma venereum, genital herpes simplex, chlamydia, nongonococcal urethritis (NGU), pelvic inflammatory disease (PID)/acute salpingitis, or syphilis, when such person knows he or she is infected with one or more of these diseases and when such person has been informed that he or she may communicate this disease to another person through sexual intercourse, to have sexual intercourse with any other person, unless such other person has been informed of the presence of the sexually transmissible disease and has consented to the sexual intercourse.

(2)  It is unlawful for any person who has human immunodeficiency virus infection, when such person knows he or she is infected with this disease and when such person has been informed that he or she may communicate this disease to another person through sexual intercourse, to have sexual intercourse with any other person, unless such other person has been informed of the presence of the sexually transmissible disease and has consented to the sexual intercourse.
