สิทธิในการก่อตั้งครอบครัว (4) : พร และ ทาเคะ ได้รับอนุญาตให้จดทะเบียนสมรส

หลังจากสอบปากคำพยานเพื่อยืนยันว่าคนผู้ถือบัตรคนไม่มีสถานะบุคคลตามกฎหมาย ซึ่งเป็นราษฎรไทยประเภทหนึ่ง เป็นผู้มีคุณสมบัติที่จะสมรสได้ตามกฎหมาย เจ้าหน้าที่จึงมีคำสั่งอนุญาตให้ทั้งสองจดทะเบียนสมรสได้ตามกฎหมาย

 หลังจากยื่นคำขอเรื่องการจดทะเบียนสมรสต่อทางอำเภอแล้ว เจ้าหน้าที่ก็ได้ปฏิบัติหน้าที่ของตน โดยเรียกฝ่ายหญิง คือ พรมาสอบปากคำ เรื่องสถานะภาพการสมรสของเธอ และเรียกพยานบุคคลอื่นๆ ที่เป็นผู้ใกล้ชิดกับพร (ผู้ถือบัตรคนไม่มีสถานะทางทะเบียน) และสามารถยืนยันเรื่องสถานภาพการสมรสของพรว่า เคยสมรสแล้วหรือไม่ โดย ทางเจ้าหน้าที่อาศัยอำนาจหน้าที่ตาม หนังสือสั่งการ กรมการปกครอง ที่ มท 0310.2/ว 1170 เรื่อง แนวทางในการตรวจสอบเงื่อนไขและการจดทำเบียนสมรสของบุคคลต่างด้าว 

เจ้าหน้าที่เรียกสอบปากคำพยาน 5 คน  โดยพยานทั้ง 5 คนนั้นได้ แก่ 1) ตัวของพรเอง 2)แม่บุญธรรมที่เลี้ยงดูพร 3)ผู้ใหญ่บ้าน 4)เพื่อนสนิทของพร 5) นายกเทศมนตรี เพื่อให้แน่ใจได้ว่า พร  ยังไม่เคยจดทะเบียนสมรสตามกฎหมาย  หลังจากนั้นเจ้าหน้าที่ก็มีความเห็นว่าพรยังไม่เคยจดทะเบียนสมรสมาก่อน จึงได้อนุญาตให้พรจดทะเบียนสมรสกับคูโดะได้

โดยเหตุผลประการสำคัญ ในเรื่องคุณสมบัติในการสมรสของพรนั้น คือ

1. เมื่อวิเคราะห์ได้ว่าพรถูกบันทึกลงฐานข้อมูลการทะเบียนราษฎรได้มาเป็นเวลาแค่ 1-2 ปี แสดงว่าก่อนหน้านี้เป็นไปได้ว่าเธอไม่เคยดำเนินการใดๆ ทางทะเบียนราษฎรเลย

2. สำหรับประเด็นว่า พร อาจจะให้ชื่ออื่นในการจดทะเบียนสมรสก็หน้านี้ก็ได้นั้น สามารถวิเคราะห์ในประเด็นนี้ได้ว่า จากการสอบปากคำพยานทุกคนให้การตรงกันว่าตลอดเวลาที่ผ่านมา ที่รู้จักกับพร ซึ่งมีรูปร่างหน้าตาเช่นนี้ เธอก็ใช้ชื่อว่า พร มาโดยตลอด ไม่เคยใช้ชื่ออื่น หรือถูกเรียกในชื่ออื่นมาก่อน

จึงเป็นไปได้ว่าเธอไม่เคยใช้ชื่ออื่นเพื่อจดทะเบียนสมรสมาก่อน ประกอบกับ

3.เพื่อนของพร ให้การว่าก่อนที่เธอจะรู้จักกับพร พรไม่เคยมีคนรักหรือจดทะเบียนสมรสมาก่อน และในเวลา 2-3 ปีที่ผ่านมา (ซึ่งเป็นเวลาเดียวกับที่พร คบหากับทาเคะ) เธอเห็นและรับรู้ในนามว่า พรและทาเคะเป็นสามีภรรยา มีบุตรด้วยกันตามความเป็นจริง

Today, I have talked with Porn. The official allow her to register marriage

I phoned to Mr.Sato , Japanese embassy's staff, to review the details of the report  the marriage registration to Japan. And he’s so glad to hear about your marriage registration. And we review the process after Porn and Take conduct marriage registration. That is the process for report their marriage to Japan to recognize their marriage.

The necessary document are :

 

1. Translated Certificate of Marriage Registration
   in Japanese
2. Translated profile registration of Porn  in Japanese

And on the day that we conduct the report to Japan at Japanese embassy, after step, both of them also apply for registration of legitimation of their child ,Yuni,.  The necessary are:

 

1. Translated Household registration of Yuni in Japanese
2. Translated Certificate of Birth of Yuni in Japanese
3. Exactly, Japanese embassy request certification of being single of Porn. Anyways he absolutely understands that under Thai law,Porn can’t get this.  So he suggest that you can use affirmative document from Thai official, mayor or chief of administration etc., to affirm that Porn is single while she became pregnant and delivery Yuni. And both of you have hold this document from the mayor of Ban
   phaek already.---I would to explain to all that of this case the Japanese embassy's staff who is responsible for legitimated of child tell me that the result of DNA isn’t  essential for Japan but he wants only affirmative document which notifies Porn qualification during her pregnant to make sure that while she is pregnant and delivery Yuni, she doesn’t marry.It is practice method.
4. Short life history of Porn and Yuni in Japanese is written by Kudo to notify they are stateless. The reason Porn  can’t get certification of being single  

And because of short time in Thailand, I plan Take and Porn have to conduct three main procedure

1. To register marriage registration in the
morning of 15^th

2. To translate about 4 documents  on 11^th by Tip and translate Certificate of Marriage Registration by Them  in the afternoon of 15th

3.to report marriage registration and register legitimation of child on 16^th

ผมคิดว่ากรอบของการใช้ดุลยพินิจจะเป็นไปตามที่คุณเชอร์รี่อ้างถึงข้างต้น แต่ว่าพอจะมีกรอบอย่างอื่นพอจะแลกเปลี่ยนไหมครับ เพราะหากจนท.ปฏิเสธ เราอาจจะต้องจดทะเบียนโดยการขอให้ศาลสั่งแทน ซึ่งก็ต้องมีกรอบอีกเช่นกัน
