วันนี้ผู้เขียนขอเสนอคำศัพท์ภาษาอังกฤษสำหรับนักกฎหมายเพิ่มเติมอีก 5 คำค่ะ ลองติดตามดูนะคะ
•Acquiescence (n.) = consent which expressed or implied from conduct. (ความยินยอมหรือการยอมรับโดยปริยาย)
Ex. A mere gesture, like the nod of a head, can mean acquiescence to an offer.
(เพียงแค่อิริยาบถ เช่น การพยักหน้า ย่อมหมายถึงการยอมรับโดยปริยายในคำเสนอ)
•Act of God = an accident or event which arises independently of human intervention and which is entirely due to natural causes e.g. earthquake. (ภัยธรรมชาติหรือนักกฎหมายบางคนให้ความหมายว่าเหตุสุดวิสัย)
Ex. An earthquake is an act of god.
(แผ่นดินไหวคือภัยธรรมชาติอย่างหนึ่ง)
Force majeur = เหตุสุดวิสัย
•Administrator (n.) = a person to whom the administration of the estate of a deceased person is entrusted by the court, which issued letters of administration authorizing the administrator to act in cases where the deceased left no will. (ผู้จัดการมรดกโดยคำสั่งศาล ส่วนในป.พ.พ.นั้น จะใช้คำว่า “administrator” (ผู้จัดการมรดก (ที่แต่งตั้งโดยศาลและโดยพินัยกรรม)
Ex. An administrator is a person who administrates the property of a deceased person.
(ผู้จัดการมรดก คือ บุคคลซึ่งจัดการทรัพย์สินของผู้ตาย)
•Affirm (v.) = to confirm a judgment, for example where an appellate court confirms the judgment of the court below it or to make a solemn declaration instead of taking an oath. (ยืน (คำพิพากษา หรือปฏิญาณ)
Ex1. The Appeal Court affirmed the judgment of the Civil Court.
(ศาลอุทธรณ์ได้พิพากษายืนตามศาลแพ่ง)
Ex2. He affirms to tell the truth while giving evidence.
(เขาปฏิญาณตนว่าจะพูดความจริงในขณะเบิกความ)
•Agency (n.) = the relationship of principal and agent, where the principal is bound by contracts entered in to by the agent with third parties. (สัญญาตัวแทน, การเป็นตัวแทน)
Ex. Agency is a contract whereby a person called agent has authority to act for another person called the principal, and agrees so to act.
(อันว่าสัญญาตัวแทนนั้น คือ สัญญาซึ่งบุคคลซึ่งเรียกว่า "ตัวแทน" มีอำนาจกระทำการแทนบุคคลอีกคนหนึ่งเรียกว่า "ตัวการ" และตกลงกันจะทำการดั่งนั้น) (ดูมาตรา 797 ของประมวลกฎหมายแพ่งและพาณิชย์)
